Terms of Service
What HeatSentry does, what it doesn't guarantee, and the terms that govern your use of it.
Service description
HeatSentry is a hardware + cellular alert product built to detect dangerous cabin temperature and occupant conditions inside a parked vehicle, and to escalate an alert (driver — designated contacts — emergency services) until someone responds. The product is currently in pre-launch.
Today, the HeatSentry service consists of:
- The waitlist signup form on this site, through which you can request notification when HeatSentry ships in your area.
- A pilot-program deployment of HeatSentry hardware to a limited group of pre-launch participants selected from the waitlist.
General-availability shipments to the broader public will begin after the pilot program concludes. The Terms below apply to the waitlist, the pilot program, and any future general-availability use of HeatSentry — the same way.
The product does not guarantee any specific rescue outcome. HeatSentry is one layer in a safety stack — not a replacement for caregiver attention, not a substitute for vehicle checks, and not a guarantee that a specific event will be detected or that a specific alert will reach a specific destination.
Eligibility and acceptable use
To join the waitlist you must be at least 18 years old and physically located in the United States at the time of signup. Pilot participants may be located in additional regions as announced.
By using the service you agree that you will not:
- Submit automated or bulk signups to the waitlist, or use bots, scripts, or third-party services to do so.
- Resell, redistribute, or transfer pilot hardware outside of the pilot program.
- Use HeatSentry branding, alert-chain logic, or device firmware in any product or service without written permission.
- Interfere with the operation of the alert chain, the device, or the service infrastructure.
Waitlist and communications
Joining the waitlist is consent to receive launch notifications from us — the announcement that HeatSentry is shipping to your area. It is also consent to receive a small number of pre-launch product updates tied to your selected use case.
Every commercial message we send includes an unsubscribe link or an equivalent opt-out mechanism. Once you unsubscribe, you will remain on the launch-notification list only until the actual launch announcement has been sent; you can then either re-subscribe or be removed.
The future SMS study program is opt-in. Study messages include a per-message STOP key. The full STOP behavior is described in our Privacy Policy: an inbound STOP removes the contact from your HeatSentry contact graph immediately, triggers a confirmation back to the device owner, and creates a suppression record on our side so we never re-add the number without fresh consent.
No medical or safety guarantee
HeatSentry is a sensor-and-alert layer. It is not a medical device, it is not a child-care service, and it is not a guarantee of any outcome — rescue, prevention, or otherwise.
The product works best when paired with active caregiver attention. The user retains primary responsibility for the occupants in their vehicle. HeatSentry augments that responsibility; it does not replace it.
Cellular, power, and emergency-services availability vary by location, by carrier, and by circumstance. The alert chain may be interrupted by factors outside our control — outages, blocked numbers, unreachable carriers, network congestion, weather, and the availability of local emergency response. HeatSentry is engineered to make those failures as rare as possible, but it cannot eliminate them.
Pilot program terms
If you are selected for the pilot program, the hardware we ship to you is loaned, not sold. You agree to:
- Install the device in a vehicle you regularly use, and use it as documented in the setup guide.
- Respond to short follow-up surveys so we can learn how the device performs in real-world conditions.
- Allow aggregated, de-identified device telemetry — consistent with our Privacy Policy — to inform product design.
- Return the device on request at the end of the pilot.
During the pilot there is no charge for the hardware, no subscription, and no obligation to purchase a general-availability unit at the end of the pilot.
Intellectual property
The HeatSentry name, brand, logo, hardware design, firmware, alert-chain logic, and related documentation are the intellectual property of HeatSentry and its licensors. We grant you a limited, non-exclusive, non-transferable license to use the device and the service for the duration of your participation in the program.
You agree not to reverse engineer, decompile, or disassemble pilot firmware except as explicitly permitted by applicable law. You may not extract the alert-chain logic for use in a competing product.
Limitation of liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to the service or the device is capped at the amount you have paid us for the device. During the pilot program that amount is $0, because the hardware is loaned, not sold.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, emotional distress, or any claim arising from an alert that did not reach its destination or a detection that did not occur.
This limitation applies even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the limitations above apply only to the maximum extent permitted.
Termination
You may opt out of the waitlist, the pilot program, or use of the device at any time by emailing heatsentry-os@polsia.app. We will process your request within 30 days.
We may terminate your participation in the pilot program for misuse of the device, for violating these Terms, or for any conduct that endangers other participants or our service infrastructure. Where possible we will give you advance notice; where the conduct is harmful we may terminate immediately.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Delaware is our state of incorporation and the place where the contractual relationship between you and HeatSentry is centered.
Any dispute arising out of or related to these Terms or to your use of the service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted on an individual basis — no class actions, no representative actions.
Either you or we may bring an individual action in small-claims court in lieu of arbitration, provided the claim qualifies. The arbitration will take place in the county where you reside, unless you and we agree otherwise.
Changes to these terms
If we make material changes to these Terms — for example, expanding our liability, changing the dispute-resolution process, or adding new eligibility rules — we will post an updated version on this page, bump the last-modified date below, and update the sitemap entry so search engines see the new revision. For significant changes we will also email waitlist subscribers.
